Paying guest's deposit money problem

(Querist) 05 May 2014 This query is : Resolved
Sir/Madam,
I stayed in a pg for 2 years and i payed the deposit of Rs5000/-(which the owner has verbally promised to refund it by the time i leave if i give 1 month notice or if he gives us 1 month notice).
In that pg so many theft happend like 3 laptops of 3 girls were stolen by a boy and no actions were taken by my owner.Bcoz of this all girls left, only we three girls are left.On 5th april (last month) he asked we 3 girls to vaccate the pg within 30th april bcz he is going to renovate/painting/white-wash the house. He stopped giving food and other facilities and mentally tortured us.

Now when we left the pg and we asked for the deposit of "Rs5000+Rs1000(he dint given food)=Rs6000/-" then he is telling the because of u 3 girls water is leaking from one of the Bathroom and i have to break the bathroom and construct a new one.I ll not give u any money, bcz for renovation of new bathroom i have to invest Rs1,00000/-,so dont come to me again and again otherwise i ll send legal notice to all 3 of u to pay more for my bathroom.

I dont have any Rental agreement or rent receipt. Please suggest something

you have no rental agreement and no proof of having made payment . for recovery of rs 6000 going to court is futile exercise

Thanks for reply,
I have one "Form" which was provided by the owner at the time of joining in which rent amount, deposit amount, terms and conditions are mentioned. In that form no where i signed nor he,only my local guardian signature is there.

Will it be helpful?

If such kind of evidence with you then approach local lawyer and act accordingly
Devajyoti Barman (Expert) 05 May 2014
Though you have legal remedy to recover the security deposit by intervention of court, that would not be cost effective.

Better do not move away till he makes you the payments.
You can lodge complaint with Police if he threatens or intimidate you.
Rajendra K Goyal (Expert) 05 May 2014
If you choose the legal path it would be costly and time consuming. May take 5-6 years or even more in decision with uncertainty as the proofs are not enough.

Better forget and enjoy tension free life.

You may try the option suggested by expert Mr. Barman and even if it does not works, you may wind up forgetting the issue as if having lost the money in transit.
