Partition of property

Sir,

I am leaving in property since 1959,alleged to be trust property without paying any rent or any municipal tax. All of sudden two years
back i came to know from one probated WILL
taken from Calcutta High Court that the
50% share of the said property belongs to me.

My question is that can I now file a suit for
partition of the property on the ground that
only two years back I came to know of this
fact.

OR else I take the plea in court that i was
aware of my share in the property but now i am filing
suit for partition.

if not, than what are the other options.

You are well within your legal rights to file a suit for partition and allotment of your 1/2 share in the the aforementioned property.

There is no question of limitation in the partition of the joint property so go ahead as you desire. It shall be better if you jut obtain the property papers of your share and keep mum qua the matter of partition as you are exclusively enjoying the whole property.

If the area of property is not mentioned in the probated will then you file partition suit to get your absolute right.
