dear experts my client has filed a civil suit for permanent injuntion and declaration for his ancestral property.
now can we file fresh partition suit regarding the same property.

yes you have right to file the partition suit

You apply for amendment of your present suit, and pray for further relief of partition, It will be allowed, unless objected by Defendant for any valid reason, [ Most probably your Appli will be allowed] u need to pay court fees applicable to your share in property.

File an application under order 6 rule 17 read with section 151 of CPC and seek the same relief in the ongoing case.
