This is encroachment of government land which is illegal.
Encroachers and their legal heirs cannot claim any right on the land encroached.

Firstly regularize your unauthorized occupation from the competent authority and after that you can effect a partition.

You have no ownership rights over the aforesaid property. You shall have to enquire from the relevant revenue department office of your State how this land can be got regularized as per scheme of state. Once you become its owner then you shall have no need to get its partition because the land shall be given specific with specific boundaries.
