Parents share in pension or special package of a deceased Muslim policeman

A, a Muslim policeman, is killed in an encounter with the millitants. The government announces a special reward for his family. The reward includes a plot and some cash. The deceased is survived by a wife, children and parents. I want to know if his parents will get a share in his pension, plot and cash. Will Muslim law of inheritence come into play here?

As per the Govt. Pension Regulations, on the death of an employee his widow is entitled to family pension, which is paid to her on monthly basis.This is personbal to her. Hnece the question of any other family member having right in that does not arise. On the death of the widow the family pension stops. As regards the plot and cash reward announced by the Govt. you have to see how the plot and the cash reward are granted by the Govt. Since these are posthumous and are announced for the benefit of the family of the deceased, they are not inherited property and as such parents of the deceased would not be entitled to them. Even assuming that the rewards are to be regarded as inherited property,Under the Muslim law of inheritance father is regarded as a residuary heir, that is he will get only whatever is remainig after the quranic shares are allotted to the wife, sons, daughters and agnatic grand sons and grand daughters.

The conditions of the special award by the government is necessary.
If the property earned by the deceased Muslim,the parents of the deceased may be treated as successors as per shariath law, and they are entitled to get their share as per shariath law.In your query it is the award by the government, so the conditions of award shall be apply.
