Is there a way to obtain an attested copy of a document from court when it still has not been exhibited in court during the proceedings of a trial, but is part of challan that has been presented in the court.
I want to obtain an attested copy of a xerox of a document that is a part of a challan in a trial, but the court staff told me that i can't get an attested copy of that document until evidence is over in that trial. In other words they say that I'll get an attested copy once that xerox document is exhibited and admitted in evidence in that trial by the judge.
So is there a way that i can get an attested copy before it is admitted in evidence?
Thanks.

Dear DJPoint,
What they told s correct.
You can get Certified True Copy of any Document from Court, ONLY IF IT IS EXHIBITED, AND Ex- No. is given to the said Document.
You don't have to wait till Evidence is Over in the trial ; Only requirement is it is exhibited , and receives it's Exh No.

I differ.
You can apply for any copy which is available on record, it need not be exhibited. We used to get it in TN.
For example, you file the original document for the purpose of getting interim injunction. For it was not marked as exhibit. You can get the certified copy of that original document at any point of time.

But I differ with Mr. Arunagiri and agree with Mr. Shroff.
In Haryana also they don't give certified copies of the documents not exhibited.

Mr.Shonee,
My suggestion is to apply for a certified copy, if they reject, go for a writ u/s 227 to High Court. The HC will issue proper directions.

If it is part of challan then you can get it.
