Not obey hukamnama of court

Sir, I want your advice once civil court given orders on suit land .the appeal in dist court is also dismissed with cost of oposit party but they are not ready to obey court orders not giving 50% share by subdividing land through collecter's staff.hukumnama given by court in year 1994.pl your valueable advice is requested what to do in this case.further they have put mangos tree without measurement of land (partition).Is it necessary again go to court for fresh order or else.than u.

Dear Mr. Namdev Kadam,

1. You could have filed an application before such court whose orders the other party are flouting under the Contempt Of Court Act, 1971. within one year of passing of the such orders.

2. Now in the present situation you can file a civil suit under Order 39 Rule 1 of C.P.C. 1908 seeking a permanent stay on the other party restraining him from disobeying the previous order of the Court.
