Non releasing of increments

Sir,

I’m an Officer of Dena bank, Bangalore Region
And my increment is not released since 2001. Reason is not known. I have submitted Performance Appraisal and Asset Liability statement every year.

The reason I asked over telephone, and I could not receive any proper reply. any one can pretend it is just a negligence of work and they are not interested in it. But for me it is loss of monetary value.

Please reply me shall I have to file petition, or I have to persuade them to release increment from 2001. This amount in aggregate comes to nearly Rs.700, 000.00.

Please guide me regarding this, if I have to file petition in court, what is procedure? or if I have ask in writing what way I have to represent it?

I suggest that first submit a written representation to the Bank Management requesting them to release the Annual Grade Increments which are due from 2001.

As suggested by our expert try it first or if they did not heed to request then move to the highcourt in writ petition on the same line of request stating the cause of action as not heeding to your request. you will get specific direction for this.

No, Mr. Vinayak in spite of being at an Officer level, would not think of giving any representation in writing for the past 10 years - but was content in contacting persons over phone and enquiring. But, he is very much interested in filing petition!

From Mr. Vinayak's posting it is also not clear whether he did not get annual increment for one year i.e. for 2001 or from the year 2001, meaning thereby that he did not get any increment at all from the year 2001 onwards.

There is something more to the story than it meets the eye.

Mr. Vinayak has to come out with complete facts. He should also indicate why he did not make any written representation to his organization.

Yes. Am also agree with mr.k.s.s and ramachandran sir. Without any written representation you can't proceed further before court of law..

Dear Vinayak,

I wonder, for the last 10 years you had not been taking up formally the question of non drawal of your increment. Better create some formal evidence before you think about legal recourse. Send formal requests/ representations and reminders. Get their formal reply with reasons for non-drawal, represent against that.

Mere verbal response about negligence of work won't be a valid reason for non-drawal of your increment. They must provide you the evidence of negligence of work on your part upon which you can represent to justify yourself.

If you have not received any communication about negligence on your part, the management won't be justified to withhold your increments.

Go with proper channel in the Bank itself.

File RTI.

Approach the higher,highrer authority,if no one listen to you then think of petition.

Don't make phone calls,do it in writing.

Dear Vinayak,

If you have already waited for 10 years long, I think it would it not advisable to you to be impatient. It would be better if you prepare a proper background by repeated correspondence/reminders with the authorities to get the desired information for about 3 or 4 months more. That process may make your case strong, if they don't respond to your correspondence before you try to fix them up legally.
