NI 138 with IPC 420

I recd one summon from Metropolitan Magistrate Kadkarduma Delhi.
The charges is i was issued one check of Rs. 27000/- in 2008 as it was dishonored due to " Account Closed" . The person is complaining that i was taken 1 lac loan and against that i release that check.

i need to appear in the court to Answer this.

What will happen? Is Court Order to arrest me?

before 23-3-2011 i never recd any notice from this person.
Please suggest.

Appear on the scheduled date and pray for bail. Thereafter fight the case on merit.

go to highcourt u/s 482 cr.p.c. for queshing 420 ipc ,because what ever is not permited is prohibited!
and 138 n.i.act is specific 420 ipc is not made out in this matter!

u will have to appear on the date with ur advocate, get the copy of the complaint, go thru it and proceed the matter on merit.

You appear before the court and make your submissions. Check the case records, if there is no proof of notice served on you, the case is liable to be quashed.
