Mutation papers

(Querist) 21 August 2012 This query is : Resolved
My Father and my uncle was the joint allottee of DDA flat in Delhi, where as my father was residing in that property with his family and was taking care of all installments and other taxes. He passed away in the year 1997 we got mutation done in our mother name after the relinquishment of our rights in her favour. The mutation letter is mentioning both her and my uncle as shareholder. Whereas my uncle dose not has any interest in the property. Later my uncle dies and followed with death of his wife (my aunt). Leaving 2 married sons, we all are close knight family and we want to have registration done in single owner name i.e. is my mother’s name. We have been told that this may require going though very long and complicated procedures. Please help us guiding though this.

1- Follow the DDA Procedure - if there is any simple procedure with DDA- by simple Declaration Form - for release of joint rights --- or---

2- Any Joint Rights can be released by Joint Owner in favour of another Joint owner by Regd Release Deed - Execution and Registration of Release Deed by Your uncle's sons in favour of your mother is required and it will take one or two days in the SRO - subject DDA Rules - Verify with Local Advocates- Regarding DDA Rules in this matter of Release of joint rights in favour of your mother.
