(Querist) 26 December 2010 This query is : Resolved
Hi. I am hindu boy from gujarat, india.
I want to know that marriage with my uncle's daughter(My father's brother's daughter) is legal or not? We both are in love. We want to marry. But first we want to know that is it legal or not?

Send me reply as soon as possible.
Arvind Singh Chauhan (Expert) 26 December 2010
That is illegal and comes under the prohibited degree in Hindu Law.
R.Ramachandran (Expert) 26 December 2010
Dear Mr. Vijay,
(I hope you have not got married before receiving the reply in this LCI. Because you wanted the reply to be sent as soon as possoble. I am afraid you are in a very great hurry!)
According to Section 5(iv) of the Hindu Marriage Act, 1955, one of the conditions for the valid Hindu Marriage is that the parties should not be within the 'degrees of prohibited relationship'. If the custom of the parties permit such a marriage then the same can be valid.

As per Section 2(g) of the Act, the following falls within the 'degrees of prohibited relationship".
(iv) if the two are brother and wister, uncle and niece, aunt and nephew, or children of brother and sister or of two brothers or of two sisters.
Since you both happen to be children of two brothers, you both fall under "degrees of prohibited relationship".

She is your sister. You can not marry. It is illegal, you have prohibited relationship. Please dont do that.

If you do so, You can be punished for 1 month Imprisonment with fine of Rs.1000, u/s 18 b of the Hindu marriage act.

I agree with experts, such marriage will be illegal and against the provisions of Hindu Marriage Act.
Devajyoti Barman (Expert) 26 December 2010
Yes, this relationship is in prohibitted relationship unless the strong prevalence of custom in your community validates such marriage.

How u can think about that. Don't u know this simple thing that she is ur sister!
s.subramanian (Expert) 27 December 2010
It is within prohibited relationship under Hindu Law of Marriage, both codified and sastric.

All the experts commented above are correct. You may change your "love" into "brotherly affection" which is legal.

this proves love is blind jo na jaat dekhe na relation aur phir dono gire tuneel mein. Bhaya kamse kam ek ghar to chodo . jahan ladki dekhi aur chalu hogaye . and even when it is illegal marriage and if u go for it then it may cause physical trouble to u r children as when marriage takes place within blood relation, there are many chances that children borm out of said relationship suffers physical defects. so better be carefull. And if this restriction which is put in act is because of this reason only so abhi se sambhal jao.

Mr. Vijay,

go for some medical test of yourself, as I dont see any merits in this except the lust involved.

Just say, what your children will call you - Papa or Mama-- Her as Bua or Mummy- Your father as Dadaji or Nanaji ---- also your offsprings will suffer from renal and chronic failures and most probably will be the blood factor and Thalessemia(Minor/ Major).
Gulshan Tanwar (Expert) 28 December 2010
DNA and mRNA will not develop and if you want this to know contact specialist doctor and not MBBS.

Also it will lead to breakage in the carbon chain and will get either - Alpha or Beta syndrome which ultimately results into the slow death of the offspring as no medicine is there for curing such.

Dont apply heart here, instead think only with brain.

And also the social implications you all will face for the ages....
