I have notarized relinquishment deed dtd sep 1997
Maharashtra govt has initiated Amnesty scheme for documents registered for less stamp duty or unregistered from 1980 to 2000 can avail this scheme
My relinquishment deed will be regularised after paying stamp duty as per valuation, physical presence of all parties who have signed on Relinquishment deed, not necessary, only stamp duty is to be paid
Should I avail this scheme?

If you want to regularise the illegality in your property related issues, you may better avail this opportunity and become free of this problem forever.

Yes. All instruments related to the transfer of immovable property under Maharashtra Stamp Act, 1958 whether registered or not. Whether residential, Non-Residential, Industrial, Agricultural, Non-Agriculture etc. Schedule I: Instruments executed between 1st January 1980 to 31st December 2000. The Revenue Department through the Inspector General of Registration and Collector of Stamps (IGR) implements the scheme. To receive applications online, verify, adjudicate, issue demand notice, collect the deficit amount and then certify the instruments as duly stamped under the scheme. You can get benefits from this.

Just by getting certified by collector of stamps, will this deed of 1997 become registered Relinquishment deed?
T. Kalaiselvan, Advocate (Expert) 09 February 2024
Until and unless a document is registered by the registration department after paying the registration charges, it will not reflect in the encumbrance certificate.
