Legal Hire Certificate

Good Morning Sir

My father died a year back. He has a property(House) in Borabanda, Hyderabad which we want to transfer in my mothers name. But there is no legal proof that she is his wife.
pls help...

were your parents not officialy married?

if married,the same might be registered at the panchayth.

YOU MAY SUBMIT APPLICATION FOR INCLUDING NAME OF LEGAL HEIRS ON PROPERTY RECORDS AT THE CITY SURVEY OFFICE BY ENCLOSING THE COPY OF DEATH CERTIFICATE OF YOUR FATHER AND COPY OF RATION CARD CONTAINING THE NAMES OF ALL FAMILY MEMBERS AND ALSO COPY OF ELECTION I.D.CARD OF PERSON WHO ARE LEGAL HEIRS.

First you need to meet your mandal Tahsildar and apply for Legal Heir certificate. You can approach court for issuing succession certificate,since your father died intestate(died without writing any will) . After getting any one of the document you need to apply to the Circle Revenue Office for mutation of the property title to your mother's name. NOC has to be given by rest of legal heirs.

For transfer the name succession certificate is necessary.For that you have to approach civil court.

In the absence of a marriage certificate or similar documentary proof,how will she proof that the deceased was her husband so that she could obtain the succession certificate?
