Legal heirship

(Querist) 14 September 2013 This query is : Resolved
An Unregistered Patnership Firm has a property in the name of the Firm.

There are 5 Partners to the firm - all brothers and sisters.( Hindus )

One sister dies. The sister has no issues/children

1. Does the property devolve on the dead sisters husband if alive ?

2. Does it further devolve on the husbands
relatives if the huband is also dead ?

Whether sister was also a partner in the firm? If so, the firm would be dissolved on the demise of one partner and can be reconstituted. The share of deceased partner would go to his/her legal heirs.

Sir --You have not answered my point.

The deceased sister was also a partner.

The point is that

1. Being an unregistered firm what is the
implication ?

DO the legal heirs inderit a share of the property or do they get only the share of the
networth of the Firm ?

P.Frederick
