Legal heir vs legal representative

Querist : Anonymous (Querist) 14 January 2024 This query is : Resolved
A person passed away without a will . He has left home long time back. He was living with someone else for last 30 yrs with the lady.

After his death, the succesion certificate was made. Now the lady he was living with has a will stating that she is his legal representative.

Already legal sucession has been issued. She has put a case of fraud against the successor.

Who will inherit the property.

Thanks

By just living with a person will not entitle that lady to inherit or succeed to his estates in any manner.
She should prove that she legally wedded him which can be challenged in the court of law when she approaches one

Yes. She is not legally wedded and cannot say she is a wife. So the successor may challenge the case if she proceeds to court.

Thank you so much for the prompt reply. Sge has a registered legal representative affadavit and now she was put a fraud case againast the legal successors claiming that she owns everything. Who in this case would be legally owner of the property.

She doesn't have any rights in the property if your information about this is correct.
Her case will not be maintainable.
You may have to challenge her case properly.

"A person passed away without a will . ....................................... Now the lady he was living with has a will stating that she is his legal representative."

Are not the facts stated contradictory? What do you mean by "............... will stating that she is his legal representative"?
