Law & taxation practice

I am law graduate and i am enrolled with Haryana & Punjab High Court.

can i do practice of Law & Taxation in Rajasthan state. Please advice.

Also Transfer of your name from Haryana and punjab bar council Roll to Rajasthan State Roll.

After the notification of Section 30 of the Advocates Act, 1961, there is no need to get the enrolment transferred from one State Bar Council to another. Even without such transfer, one can practice at a place other than the State where one is enrolled.

Any law graduate can do the taxation practice. You must enroll as legal practitioners in the concern Tax Department.By filling F139 to the ITD and Chief Commissioner of Sales tax.

With Due respect, I humbly disagree your views that "there is no need to get the enrollment transferred from one State Bar Council to another."

As BCI rules, He Shall have to apply for transfer of his name to the roll of the State Bar Council within whose jurisdiction he is ordinarily practising within six months of the start of such practice.

"(Rules under Section 49 (1) (ah) of the Act)
1. Every advocate shall be under an obligation to see that his name appears on the roll of the State Council within whose jurisdiction he ordinarily practices.
PROVIDED that if an advocate does not apply for transfer of his name to the roll of the State Bar Council within whose jurisdiction he is ordinarily practising within six months of the start of such practice, it shall be deemed that he is guilty of professional misconduct within
the meaning of Section 35 of the Advocates Act."

Yes no need for registration to new bar council.

You are member of the parent bar council and due to recent amendment can appear any where.

Respected Sir,

He have to Transfer of his name from Haryana and punjab bar council Roll to Rajasthan State Roll as per BCI Rules. Irrespective of section 30.

If he don't do so then it shall be deemed that he is guilty of professional misconduct.
