Dear sir,
We purchased property at navi mumbai & property registration done between me ( applicant) & my brother is co-applicant.Initial investment for registration is from my father.(3.75 lac) & this property purchased when we are leave together.
For loan, that time we both are in job & younger brother education is going on.My father is meson, so he dont have any legal document which are required for loan. so we both are applied for loan for 10 lac.First EMI of loan was started from NOV.-2005.
After registration, my brother ran away from home for love marriage & he can not pay any EMI UP to june -2009. He re-join family from May -2009 & again leave from July2011. In that period he paid 50% EMI.
Based on his EMI shared, his investment is Rs.1.68 lac. my investment is Rs.5.78 lac & my father investment is 8.8 lac up to June -2011.
Now he wants his share, He wants 50% profit share from the property. When i asked for father & younger brother share, he is not agree to give the share to them & harrasing us.
I already given him 4.0 lac rs. now he was told me i will take you in court. for that i want some guidance from you related to this

can you help me out from this problem he's unnecessary harassment us

Dear Dinesh
as per your query, the registration of the property has been done between you and your brother, according to this registration he is the owner of 50% share of the property according to law. no one can stop him to get his share, you can demand Investment money or EMI's payment, if he is not ready to pay, you can file a civil suit for recovery and permanent injunction against him.
feel free to call

Your brother is the joint of the property, so he can claim 50% share in that. Make a compromise and get solve the problem.

Your brother is 50% owner of Flat. Your father and 3rd brother get nothing. , it is not their property.

Wife of your love marriage brother must be master mind., and she will get it . If paid 4 Lakh without proof or without documentation, you lost that too. At least, now onwards, Let him pay all balance EMI. Save your further loss.
