Late intimation of false fir to department.

Dear Sir,

I am a government employee. When I got my job 2 years back a false criminal case was slapped on me just after 3 months of job. It is a dowry and false promise of marriage case.

I applied for Anticipatory bail. Same was granted by the court. I was never arrested by the court. I informed about this case after almost 1 year to my department. My opposite party is continuously sending complaint letters in my department. Though I wasn't arrested at all will my department take action against me? If yes what could be the penalty.

I am very stressed, facing trial and Fear of departmental actions. Please help me

As of now, you are not arrested. So the department cannot suspend you. If the case is against you, then action will be taken.

Arrest is not essential in cases where punishment is below seven years. And you have pre-arrest bail which indicates that you are better placed.

Above all, the continuous complaints reaching your office will indicate that law is leaning towards your side and your opponent is weak in her case. So, your department may not take any action in your case if they are sensible enough to read the pulse. It is not binding on them also unless you are punished.

It seems you are on safe side. But you will have to undergo the court procedures which itself is a sort of punishment. But the Magistrate is a reasonable person it seems you have every possibility to get discharge at the time of charge framing.

Thank you K rajshekhran sir. Actually the opposite party is sending complaint letters through, CPGMS, RTI, Letter through India post and through multiple channels.

They want me to get suspended from job, starve for finances etc. I really don't know how to stop this harassment. Though I have secured anticipatory bail, but because the matter is against women, and they have added foul colours in the story. So people are doubtful.

I reality the girl herself denied to marry me but later complaint against me under sever IPC sections.

Admittedly, the authorities have not taken any adverse notice of the issue. Rightly so because you have not been arrested. The FIR registered or the ongoing trial is not a cause for taking any action against you. There is nothing to be concerned so long as you are convicted.

As regards to complaints or the information sought from you, they are of no concern to you and hence a non-issue. Let the authority concerned, deal with the matters at their discretion.
