What is the legal position of the property which has been transferred without the Khatha standing in the Seller name? How can it be rectified?

What is the proof of the seller that he is the owner of the property? If he is not the owner the sale is invalid.

Entry in Khata shows only possession not ownership. If the seller has proof of ownership, the sale is valid otherwise not.
