Company in Mumbai wants to file a prosecution under section 452 of the Companies Act against its employee. In which Court should it be filed? Metropolitan Magistrate or Sessions Court? Is there any case law?

The two replies given by the "Experts" do not behove them. If I am to take advice from professional, then why should I put the querry to the experts on this forum? The experts are expected to give their expert opinion unless they do no know the answer. "Consult a local lawyer" is not proper reply from an Expert. Plesae give proper reply.
