Joint nomination after death of a member

(Querist) 07 February 2023 This query is : Resolved
IS JOINT NOMINATION ALLOWED IN A COOP. HOUSING SOCIETY IN FAVOUR OF BOTH SON AND DAUGHTER (MARRIED) IN CASE OF THE DEATH OF A MEMBER UNDER THE WEST BENGAL COOPERATIVE HOUSING ACTS
Quick Summary
This discussion examines the validity of joint nominations in West Bengal Housing Co-operative Societies, specifically when a member dies. While Rule 76 of the WBHS Rules allows a member to nominate a person to receive their share upon death, the interpretation suggests that a joint nomination favouring multiple beneficiaries, such as a son and daughter, might not be permitted. However, it is noted that a member can specify the share of each beneficiary in a nomination.

As per Rule 76 of WBHS Rules, Any member of such Co-operative society may in accordance with the rules nominate a person in whose favour the Co-operative society shall dispose of the share or interest of such member on his death. Hence I opine the joint nomination is not allowed.

Nomination can be made detailing share of each person/ beneficiary by member of Cooperative Society.
