Is ex service man sells the govt issued land ?

I am the son of Ex service man ,my father retired from army in the year 1997 and he got 5 acres of land in the year 1998 , after that immediately he sold the property to others at the time of sale my age was 13 years, my father was expired in the year 2009.and my mother also expired in 2006 prior to father's death,leaving younger sister and me ,we are home less so
can i get chance to file a case for that 5 acres of agri land ?

The land allotted to ex-servicemen is often subject to conditions regarding alienation (transfer or sale) of the property. Typically, a period of 10 years from the date of assignment is required before the land can be transferred or sold. Additionally, some instances may require a No Objection Certificate (NOC) from the government before alienation, although this requirement has been dispensed with in some cases.
In essence, while ex-servicemen may have the right to alienate land after a certain period, they should be aware of any conditions or requirements imposed by the government or the state revenue department, such as the need for permission or NOCs.
Hence you first of all become aware of the conditions of the land assigned to him and then confirm if your father had followed the proper procedures to sell the property, if not you can get the sale deed invalid through court order.
However the risk is that the assigned land will be taken back by the government if the fraud has come to the notice of the government through the court order.
