Advocate Bhartesh goyal (Expert) 22 April 2013
Burden of proof lies generally on plaintiff who desires the judgment on any legal right.please go through the Sec 101 of evidence Act
101. Burden of Proof -

Whoever desires any Court to give judgment as to any legal right or liability dependent on the existence to facts which he asserts, must prove that those facts exist.

When a person is bound to prove the existence of any fact, it is said that the burden of proof lies on that person.
Rajarshi Bhowmik (Expert) 22 April 2013
According to Section 101 of the INDIAN EVIDENCE ACT he has to prove the case who says in the affirmative. Therefore in your case the Plaintiff has to prove his case.
