You want to withdraw FIR which is with police and petition which are before courts
Advocate. Arunagiri (Expert) 17 December 2015
The complainant can give a letter to the Police Station, stating that he wants to withdraw the complaint. Recording this the police will close the case.

If they have filed any charge sheet, the defacto complainant has to file a petition before the Magistrate for compromise. Recording this the court will close the case.

Minor child has expired and the police has got statements against the accused. Consult local lawyer and proceed.
T. Kalaiselvan, Advocate (Expert) 25 December 2015
If any case has been registered under section 304A IPC, then the case may be defended in the court appropriately. It may not be possible to withdraw the complaint if the charge sheet has been submitted before court by police.
