Harassment by in laws

Hi SIr/Madam,
I need a legal advice on my situation.
I am from pune and had arrange marriage 3 years ago and living in bangalore with in laws. Since marriage I had been harassed for money inspite of giving them. As my in laws and husband were not satisfied, they started troubling me by restricting food and basic amenities and forcing me to go out of the house.they had beaten me several times and i had raised ncr complaint in womens cell....now they have strategically planned to remove me from the matrimonialhome by asking my husband to move out..and everytime in laws and husband agrue with me that go and stay where the husband stays and i am an outsider and have no right to stay in the property......but i have been denying as i dont wish to move out of the matrimonial home ..few days ago my husband had asaulted me and had a mouth injury and was admitted in the govt hospital where mlc case was register....all this while I hoped that things would get better and didnt raise FIR..but after this incident ,I planned to go and raise FIR..but before I could go my husband has sent me a petition from court asking me to join him in the rented house...and had put false allegations in the notice against me....please could you advise me what I should do

You have filed a complaint in NCW against your in-laws. What is the result of the complaint? If you don't receive a response, you can check online and consult a local lawyer to file a criminal case against the in-laws.

You have rights to reside in the shared household where you started your matrimonial life, hence you can deny to leave your matrimonial home and can ask your in laws to obtain a court order to evict you. To your husband's notice you issue reply notice denying his allegations and also refuse to join him at the new place citing your fears that he will abandon you at the new place and run away once you go there to reside with him and also about the fears of physical assault citing the previous incident

What is the problem in joining the husband? Why you want to be in the matrimonial home even in the absence of your husband?

The reason I don't wish to join husband is because he and his family have strategically plan to remove me out of the house....since the marriage they demanded money from me and family and as they were not satisfied....they asked me to go back to Pune which I denied and now he has taken a rented house to show the court that he is staying separately....also I had been assault by him ...on 8th nov I was admitted to hospital ...if he and his family repeated tells me I am an outsider and have no right to stay in the house ..it clearly shows that he is planning to dump me.....and he tried so hard to take me atleast once in the rented house but I never went

It appears that you are trying to retaliate than act. You can seek separate legal remedies for the dowry and physical harassment. In my considered view that, in the absence of competent legal proceedings, no useful purpose is served by continuing to stay in the matrimonial home away from your husband.

All this while I was hoping things would change but it didn't and they are trying very hard to remove me..I want to continue with the marriage and does not want to break it but with dignity and respect in the matrimonial home and not outside and that is why I am proceeding with the fir to get help where the torture can be stopped

The proposed legal actions will escalate the problem more than providing you the desired relief hence take a wise decision
