Guardianship of grandchild

Querist : Anonymous (Querist) 02 January 2012 This query is : Resolved
In a tragic accident, a friend of mine lost his only son living behind a widowed daughter in law and a young just born boy child, who is now 4 years. The friend arranged for second marriage of his widowed daughter in law, who is happyly living now. with her consent he kept the grand son for bringing him up, as the only sign of his deceased son.
Now whenever he approaches Banks for depositing money in FDs for future provision in the name his minor grand son, the Banks are asking for Guardianship, he is also willing to make him nominee for his flat/property and other savings. What legal document he needs which will be legally acceptable in all these. What is the procedure. Pleas guide.

THE MOTHER IS A NATURAL OF BOY.

CAN GET GUARDIN SHIP THROUGH COURT. WITH CO-OPERATION OF HIS MOTHER.

BE CAREFUL, ONE CANNOT WITHDRAW MONEY, NOR CAN TRANSFER PROPERTY OF MINOR, WITHOUT COURT ORDER. SO DO NOT DO IT.
A WILL BE BETTER.

AS OTHERS CANNOT WITHDRAW, BUT ONLY DEPOSIT IN MINOR'S BANK ACCOUNT, THAT END THERE IS NO PROBLEM
property ONE MUST NOT.
NEED TIME TO SUGGEST WITH DIFF PROPERTY. transactions, AND IT'S FUTURE WEALTH, SHARES, GOLD ETC,THAT IS BIT COMPLICATED LONG 20 YRS PERIOD ISSUE .

Mr. Shroff has correctly advised you.
Mother is the natural guardian of the boy and your frient can get guardianship through order of the court.

Yes you need to apply the court for court appointed guardianship. Since the mother is there, she needs to give her consent in the court for such appointment.
