Can gratuity be with held by a company even after completing 5 years?

Sorry I meant to ask that you have submitted your resignation and employer hasn't relieved even after 60 days of serving notice and not giving the relieving letters.

What do you mean by, "YOU have submitted your resignation." First of all your initial query was merely an academic query. Secondly, this seems to be not your own problem when you say, YOU have submitted your resignation." Thirdly your clarification is quite different from your initial query.

Can you clarify your puspose of asking for such a vague academic query having no relation with you?

Has the company declined in writing?
If yes who has signed the declinature and what reason is stated in writing?


The declinature and forfeiture of Gratuity are two different issues.
