Gpa for an nri

I have an NRI friend who wants to buy property in India.

Whats the procedure for getting an GPA from an NRI authorizing me to buy property in his name?

Get the PoA prepared by whoever is preparing your documents in India. Send it by email to your friend. Ask him to take a print out, sign it on every page, and get it attested by the Indian Consulate / High Commission.Public notary.Courier the attested paper back to India.

Within 7 days of reaching India, the paper has to be presented to the District Collector for stamping (pay stamp duty).

It may also have to be registered if it relates to SALE or PURCHASE of immoveable property by him. Depends on the rule in each State.



If this is for registering a deed where you are selling land, better get the PoA cleared by the buyer too. Details of the property need to be included in the PoA in this case; hence you better it prepared by a solicitor / document writer.

It is related to the purchase of immovable property so where should i get it registered?

Ans. The area where the agent lives.

The POA is not perse registered but should be adaequately stamped for the purpose of getting the document registered onto your friends name for which you are authorised to carry out such deeds and actions which may be required to get the document registered by the vendor, only a POA for sale requires to be compulsorily registered since you present & execute the document on behalf of the principal. In a purchase transaction only the vendor presents & executes the document, hence the POA is an optional registrable document. None the less some sub registrars demand registration of the POA in such case you need to register the same at the registration office under whom you reside. This is generally so since the rules may vary from state to state.
