Gift deed without building is valid or not?

RESPECTED PANEL OF EXPERTS,
MY GRANDFATHER IS 85 YEARS OLD. HE HAS A 2 DECIMAL OF PLOT WITH A TWO-STOREYED PUCCA BUILDING ON IT.THE PLOT IS A HIGH VALUE COMMERCIAL PLOT. HE WANTED YO GIFT IT TO MY MOTHER. BUT WHEN I SAW THE COST OF GIFT REGISTRATION IT WAS VERY DIFFICULT FOR ME TO COLLECT THE BIG AMOUNT. THEN I DECIDED TO REGISTER THE PLOT WITHOUT SHOWING THE BUILDING. MY GRANDFATHER GIFT THE PLOT IN APRIL, 2015 AND IT WAS REGISTERED THEN.NOW IF I WANT TO REGISTER THE BUILDING SHOWING IT AS A NEW CONSTRUCTION. CAN I DO SO WITHOUT PROBLEM? PLZ SUGGEST.

@author, where the property is situated? you get the document registered without building. if it is found that the plot was registered without building, it leads to penalise the amount. Now if you shows as a new construction, then also it costs more.

I am afraid, your action as well as fears appears to be misconceived. Firstly, in most of the States, registration of gift deeds involving close relatives involves only nominal expense. Secondly, you can very well take the stand the building remained to be shown in the deed due to oversight and get the rectification carried out. Please note that value of buildings, unlike land, never appreciate, but only depreciate, in course of time.

Normally the Registrar Office Staff would Inspect the Site of Registration before releasing the Documents after Registration.In your case Silence is Golden as far as Registrar Office is Concerned and You Could Pay the Property and Other Taxes as Usual after Transferring the Same In Your Name.

Just for Your Information Normally In Cases Like You "Settlement Deed " would be the Best and it is highly reasonable and Less in the Fees Of Registrations.

May be possible for regularisation of the building saying that it is constructed with prior plan approval.
