I am one of the trustee of a trust.
My forefather in year 1890 made the trust and declared that all his adult heirs shall become trustees of the trust from generation to generation. Now one of my married sister wants to be trustee. I refused her on the ground that when the settler made the trust at that time (year-1890) females were not treated as legal heirs.

Am I right or wrong ?
Rajendra K Goyal (Expert) 06 December 2014
Presently female are legal heirs, however, full document has to be referred. Consult local lawyer.
Sailesh Kumar Shah (Expert) 06 December 2014
without going through the trust deed, no opinion can be formed, consult local lawyer.
T. Kalaiselvan, Advocate (Expert) 07 December 2014
As per the amendment to succession act in the year 2005, the females are equally entitled to a share as a coparcener subject to the conditions laid down therein. Consult a local lawyer with relevant papers and take his further opinion.
