Right to take leave due to health issues.

(Querist) 23 August 2018 This query is : Resolved
Hi, I am working in Top level MNC since 4 yrs. Since last year I am suffering from severe eye infection due to this am not in a position to work with laptop because of
watching laptop , redness in eye increasing and also am having eye burning , eyelid swell.
Due to this eye have requested for long leave for 6months by submitting all medical reports to HR. Request has been rejected by HR and they said that they can give leave only for 1 month.
As a employee can i have right to request for long leave due to health issues.

There is a marked difference between right to request for leave and right to take leave. An employee can request any time for leave but discretion to grant leave always rests on the employer in the interest of service.

However, leave on medical ground cannot be refused, if the specialist doctor prescribes bed rest. Your eye specialist in medical certificate must recommend that leave is quite essential to avoid reading, writing and computer jobs to save the vision from deterioration.
