Election of cooperative society

(Querist) 23 September 2017 This query is : Resolved
I would like to know whether co-owner in any of the society can contest society elections. For e.g. if the flat is in the name of husband as first application and wife as second applicant. Can wife contest for any post in the society elections.

Rajendra K Goyal (Expert) 23 September 2017
Generally not.

However, refer the bylaws of the society.

Depends upon, who is the member of the society. Member and the co-owner can be different.
Hemant Agarwal (Expert) 24 September 2017
1. Subject to Maharashtra Coop. Societies Act (MCS Act), "ANY" of the joint-member (joint-owner) (aka associate member) can contest /vote / Propose /Second at the Society elections, BUT "only" with the consent of the FIRST "primary" share holder, by executing Form-10 of the applicable bye-laws.

Keep Smiling .... Hemant Agarwal
