Leave without pay on medical ground

Dear Sir / Madam
Due to my treatment I could not perform duty for 3 years in Railway . Authority sanction my leave LWP on medical ground and also regularise my service . now my query is can I get increment for this 3 years LWP period ?

No benefit can be permitted for leave without pay till specifically allowed in your service rules.

Dear Goyel Sir ,as per master circular 58 Rule 1320 (FR26) all kind of leave and EOL on medical ground count for increment

Yes, EOL medical grounds (i.e. on the strength of medical certificate) counts for increment. When you the rule position, why this query?

first of all you knew the rule and yet made a query without quoting the rule. Prima-facie you were taking test of the experts.

Now you know you are correct and also know that the position is not accepted by the Govt. You also know that you have a remedy to go to CAT but you still are not contacting any lawyer.
