Cancellation of gift deed

A grandfather wrote a gift deed (unconditional) for a self acquired property favouring his granddaughter when she was a minor. The gift deed was duly registered.The grandfather is not now alive. There is perfect understanding in the family and the granddaughter( now married) is willing to get the gift deed cancelled.As the donor is now not alive, can the donee and the legal heirs of the deceased grandfather cancel the gift deed through a properly drafted cancellation deed and get it registered? The family would prefer this mode of cancellation rather than the granddaughter gifting it back to the legal heirs of the deceased, in this case father,grandmother and aunt.

As the Donor is not alive better execute a settlement deed in favor of the family members to whom you wish to transfer.Consult a local good advocate or a senior document writer in concerned registrar office

Other factor also applies like Stamp Duty registration fee. In some state like Maharashtra Stamp duty is 500 and reg. fee 500 . So such all things are required to be considered before taking decision , else deciding wrong deed can cause financial stress more. Additionally selecting wrong type of deed may also lead to disaster looking at various law . So better take proper professional help of Adv and not typist outside court

Please identify yourself. However, as the donor is expired it is not possible to execute cancellation of Gift deed. If the donee wishes to transfer the property which she got through the gift deed to any legal heirs of the donor. get it be drafted by a Senior document writer of the registrar office concerned. or consult the local Registrar.
