Caveat renewal is it necessary

(Querist) 13 September 2013 This query is : Resolved 
in family court marriage is dissolved and our advocate suggested for applying caveat in high court and agreed the same contentions is that party should be made for stay and appeal .
and also told caveat valid for 3months and after 3months it should be renewal.
now the questions is that if we don't renew is it possible for other party to stay the lower court judgment and go for appeal
but known lawyers suggest caveat not required for for renewal after 3months i.e from date of judgment and also suggest even you can remarry after 3months from the date of judgment and if they later go for appeal no problem

pl clarify for above the matters go for renewal and remarry after the 3months

Caveat is nothing but the court will not give any stay without asking caveator's opinion. The caveat is only valid for 3 months. But there is a time for filing appeal. In general 3 months. That exclude the applying copies for lower court judgements. (i.e)If the person is applied copies on that day means if we got judgement copy after 15 days means. He can have time to file appeal in 45 days. In between if you remarry means it is null and void
