Vakalatnama

(Querist) 03 September 2012 This query is : Resolved
Respected sir/madam,

I am a law student and my query is what is the personal liability of an advocate if it is found that the signature on vakalatnama on the basis of which he has been appearing on behalf of a particular party is forged??? is there any law which state that the party has to sign in the presence of his lawyer??????or that the lawyer has to check the identity proof of each and every party who is coming to him??? what are the consequences of representing on the basis of forged vakalatnama?? As the normal practice is in good faith that the vakalatnama is either sent to the parties through email or even handed over to one of the party to get the signature of the other parties if they are related to each other...pls advice me on this point...

if client has sent vaklatnama by post with covering letter an advocate cannot be blamed if signature is forged . advocate relies upon client to send him document duly signed .

if advocate has represented client knowingly that signature is forged on complaint made to bar council action will be taken against him by bar council
