Illegally/unauthorised person using my house address, which act and section applies for petition

(Querist) 12 May 2012 This query is : Resolved
Respected sir,

This is S P Goel. Some person known to me is using my house address without telling me and without my permission in documents like Passport, Visa, car bill, registration certificate of car, car insurance, Life insurance from different companies, Provident fund department, medical policy, PAN number, income tax return, National Saving certificate, Post office savings, Banks accounts in different banks and FD,Public Provident fund, Mutual Fund, mobile connection, purchase of AC etc.

I have sent a legal notice to him on 14.05.2011 for which acknowledgement is available withme , requested to change the address and send me a copy of all with changed address, but after one year, he did nothing.

Kindly give your valuable opinion, guidance and suggestion under which act and which section , I can file a suit petition against him since risk of any mis-happening is mine at present.

Pls reply and oblige sir
Thanks and best regards

Mr. Goel,

If you are referring to your son or your wife as a known person but living separately, you will only be acting in a fit of frustration with 99% chances of failure for you. Unless you disown your son or divorce your wife, you cannot forbid any one of them to use your address as their permanent address.

So, if you think to sue any of them, better think atleast for ten times in your own interest before you take any such course of action.

There is no problem to ruined institution of family but people feel sorry after fits of anger. Solve your matter amicably with the help of family friend and relatives. Other wise he is trespasser take legal(criminal) action.

Dear Mr.Goel,

I am sure this is in continuation of your earlier post"Sir, advocate required for cyber law case pls" dated 2nd May,wherein you have mentioned that your son has used your email id.I feel this is your family feud. The actual reasons for these acts both by the father and son are unknown. There must be something missing, which I feel could invariably be repaired for a good reunion.Hence instead of running after courts spending time and money, better resolve the matter, within the closed doors. As an advocate I can advice you to file criminal cases against your son and wife under different sections, but I don't think it would be a respite for all.Hence involve other elders of your family and settle the matter. This advice is to your son also.
