I am a salaried person. My salary is 30,000 per month. but my employer given me 22000 per month from Apr-11 to Mar-12 and balance salary given me in Apr-12. while releasing the balance salary my employer deducted TDS on whole salary i.e. according to 30000 pm.

I want to know that can i apply for refund of TDS or not. Since in whole year i have received salary 22000 per month.

No. You cannot claim refund of TDS.

The balance payment you received in april is your leave salary for the last year. That too will be considered in calculating tax.

There are many investment plans to save tax. Go for it.

Tax is levied on due or received whichever is earlier basis. Your employer is right in deducting TDS on 30000/-.

Tax deduction at source by your employer is correct and no refund there for can be successfully availed by you.

Your employer has rightly discharged his obligation to deduct and deposit tax calcualted on the basis of your gross earning for the year. In case you have provided him details of any investments made by you which qualify for deduction under chapter VIA sufficiencly in advance and he has not allowed you the credit for the same or you had certain investments which were not notified to him, and your ultimate tax liability is less than what he has deducted, you are free to file your return of income and claim refund.
