Hello all,
This is with reference to the registration of part of land without concern of Daughter and Wife.
My mother is the only daughter to her parents,she has neither brothers or sisters.
My maternal grandfather has inherited ancestral property which he got from his father divided among his 3 Son's A,B,C. My mother is the daughter if A.
A is his early 80's and was having issues with his health. From past 2 years he fell down from two wheeler and had head injury. Hence we treated both private and government hospitals.
A's is having his wife alive and she is in her early 70's, A and his wife are staying in the inherited land,by building house and making it as a farm house. There is a running Crop loan in the bank, and the same is behind updated in the RTC and Encumbrance certificate.
C didnt not inform A's wife or daughter and had sale deed registered for the part of land inherited from A last year. and also got katha done in his name.
I have filed a Civil suit against him to request the honorable court to have the sale deed void and to get back our full land.

Meanwhile have informed Lokayukta of Karnataka informing that the sub registrar and the secretary of our village have worked on behalf of C. content of sale deed is A is not being looked after by my mom and for medical and to have day to day activities C has lend money to A, and when A's daughter is in no position to repay the amount the part of land is sold to him. The Crop loan which is taken for the whole property is said to be repayed by the remaining property, and C can use the bought land from A without any issues and he can even sale it.
Secretary has given our Ancestral certificate stating the members of our family, which clearly indicate that my mother is only daughter. Even with all these information handy Secretary is bribed and Katha has been changed to C name.
Requested Lokayukta to take necessary actions on Sub registrar and Secretary.

My mother is planning to file a PCR against C, Kindly let me know would that be helpful, and Can ask for compensation or request to jail C in front of Honorable court.

Can I request for jailing him under cheating case or can i get a financial compensation of around 10 Lakh. Which would be better..i want to do in reasonable cost. kindly suggest

You have taken appropriate steps, let courts decide on the matter.
Has there any forgery been done, you can file a case w.r.t. the same as well.

In the given facts, it is the best case to be filed under section 420/467/468/471/120B IPC against C and all persons involved in this crime. Civil suit has already been filed by you so persue both cases vigorously and effectively.

You have appropriately been advised by the experts. You cannot suggest or impart instructions to the judiciary/Lokayukt on putting the accused in jail. They know the provisions of law. Let the authorities use their own wisdom.
