valadity of affidevit

Sir..
plz solve my problem... there was 4 partner in Industrial Firm (father And 3 son)having industrial land frm industry department on lease deed for 99 year in 1970. After death of father brother 'A' have given an notarises affidevit on Rs100 non judicial stamp paper that due to shifting in Punjab he was unable to continue in that firm ,so he is transfering his 1/3 partership share in favour of one brother 'B'. So on behalf of that affidevit brother 'B' demanding to Industry deprtmnt that 2/3 of alotted land (4 plots each having area of 5000 sqr feet)should allot to him separately in proprietorship because remaining both brother are not intrested in partnership. Q1.what is the legal way to perform this dividation of property between two brother. Q2.Is affidevit of brother 'A' is sufficient for this and what is time valadity of any notersied affidevit ?

get a registered surrender deed executed from 1 in favor of other,better A' also joins it,since his notarized affidavit is not a valid document.
