Co-operative Housing Socities

(Querist) 09 March 2011 This query is : Resolved
Do I need socities permission (NOC) before renting my flat to bachelors?

Does a co-op soc have the power to ask owners to vacate the flats if rented to bachelors in Gujarat?

Dear Amrita,

If the society has passed a resolution with majority vote that before renting a house permission be sought from the society to that effect then it will be necessary for the owner of the society flat to observe that decision.

The second part of the question does not seem to be clear, whether the society asks the owner to vacate himself the flat, or to get the flat vacated from the possession of bachelor tenants.

However, it is not within the arbitrary power of the co-op society to ask the owner of the flat to vacate his own flat. If the society has any objection to any unlawful activity of the flat owner, the society can direct the owner to discontinue the said activity or can lodge a complaint with the police.

But, about vacation of flat by the bachelor tenants, if the society has the majority vote of its members or the bachelor tenants are engaged in any unlawful activity, it can direct the owner to get the flat vacated. However, if none of the above, but the society feels the modesty of the neighboring ladies modesty to be at stake, the society can request the owner to get the house vacated from the miscreant bachelors.
