Criminal case u/s 304A of IPC , in case of a govt. job

Querist : Anonymous (Querist) 22 February 2011 This query is : Resolved
Sir

I have a query ,
Breif Facts : In case of a govt. college Lecturer, driving a car ,gets involved in a road accident with a bike and the person riding the bike dies, although no fault of the driver of car is proved , although case is pending u/s 304A of IPC in district court.

I wanted to ask what will be the consequence in case of conviction of the car driver ( even if it is a compensation award) in case of government job of the driver ?

Whether it amounts to moral turpitude or not ?

Whether their ll be any effect on the govt. job status?

The driver can lose Government job only if he is convicted with jail term on proving his guilt. In that case only the case can be treated of a moral turpitude. He cannot lose the job before his conviction by the court of law. If his guilt is not proved in the court of law, he may not lose his job.
