father's share capital in P Ltd. co.

Querist : Anonymous (Querist) 27 January 2011 This query is : Resolved 
My father was fooled in to becoming a share holder in a P Ltd. co. floated by my two brothers with ulterior motives and had 40% stake in it. He died intestate in Jan. 1996 and the two brothers with criminal mind did not disclose this fact and the profit of the co. to other 3 legal heirs. Now we have found the proof from MCA website. Pl. advice how we can make them declare the whole accounts of this co. till his death and how his assets will be shared ? The paid up capital is 24lacs.

you will have problem under limitation act, when did you come to learn about it ?

You can file a civil suit against your brothers.

You have to file a suit for rendition of accounts and distribution of the share of your late father.
Your late father's share would go equally to all the legal heirs (i.e. your mother, son(s) and daughter(s) and your father's mother if she is alive.)
