Does point of juristiction apply to dismiss the rape case

Live in relationship went bad between indian students in australia. The girl stocked the boy during his time of marriage and filed a rape case against him and went back to australia. All the occurance of the case is in australia. Can the case be dismissed.

What do you mean by 'went back to australia'. Until this line is not cleared by you, the proper answer can not be given.

FIR can be quashed against personal vengeance as live in relationship is purely a voluntary act without any legal sanctity attached to the relationship, and she can not charge her partner after satisfaction of her sexual appetite for not marrying her.

the Case was raised against the indian boy by the indian girl for the live- in - relation that occured 2 years before his marriage. During the marriage the girl filed the case and flue back to australia. so just the case is pending. The charge is framed as 376
