need advise

(Querist) 09 November 2010 This query is : Resolved
Brief summary of my last query,
Married in Jan'2010. After lot of quarrels and fights of my wife,

with my parents and me, many a times scene created at my home I

got separated from my parents and started residing in a rented

accomodation, but there also things didnt go well.
Now my present query:
On 27th october in the night at around 11pm, my wife started

fighting with me and said that I am going and I wont stay here. She

called up her brothers, sensing some foul play I left the place

silently without any fights.

At around 11:45pm I recieved a threatening call from her brother.

At 1am I got a call from local police station, I went PS. There

they had given a false hand written complaint that I used to beat

her and all. Police at that time asked me whats the problem and

ask both of us to leave within 10 mins. Before leaving she and her

brothers spread rumours about me.

Action I took, I put a detailed complaint in the local police

station as well with the Commisioner office and Dy.Commisioner

office on the very next day.
I am also filing a divorce petition on cruelty basis.
My lawyer is asking me not to vacate the rented accomodation.
Please tell me for how long should I keep the rented

accomodation??
While going from police station my wife was shouting that she will

go to women cell, but till date I hadnt recieved any communication

from girl's side.
Had I taken right steps?

Still you got time to sort out the differences between you and your wife. Take the help of the elders and convince your wife, inspite of it she didn't turn out you can proceed with the case.
In the matrimonial proceedings there will also be reconciliation stage.

Yes.U have taken the right steps.
As for your rented accommodation, it is advisable U keep it for some more time as otherwise, your family dwelling house may be engulfed in the problem.

Thanks a Lot for you advise.
Chanchal, Please tell me for how long should I keep the accomodation.
Also I filed a divorce petition under Section 14 (For waiver of 1 year mandatory period) and under Section 13B under cruelty.
Can you please provide me with some citations regarding Section 14, i.e applying for divorce before period of one year.

I think you are acting in haste. Let some time pass to cool off the matter.
