RESIGNATION OF PROBATIONARY EMPLOYEE

Querist : Anonymous (Querist) 05 October 2010 This query is : Resolved
Sir, I would like to inform you that an employee has joined as probationary officer in a private bank. Now she wants to resign. But Bank is asking to pay 50,000/- Bond amount + 3 months salary+ serve three months notice period. Is it legal to hold the employee for all these? Since the original certificates are held by the Bank, how to go about the issue. Is it necessary to comply as above and no remedy to the employee? Pl answer at the earliest.

Thanks

Absolutely legal under the terms of employment with the Bank.

Thanks. But will it amount to exploitation of a hapless employee who need to agree for terms of employment at the time of joining. How legal it is to take an employee under Bond and with so many other conditions as above.

I am surprised that there is no legal remedy for exploitation of umemployed in the country.

You are looking at the problem one sided, the bank has conducted the recruitment exam, spent amount on getting you trained for the job and now suddenly you have better job with good salary you want to abruptly leave the service. By recruiting you the person next to you has not on remained unemployed but might have lost oppurtunity, place yourself in such a position before talking about the future of hapless unempoyed youth, try to appreciate good things rather trying to find fault with the system.
