Divorce after 1 year of seperation?

respected sir,

iam a muslim and for one reason iam disapponted in my religion.

i was married last year in june. was sent back to my parents house by my father inlaw in the month of july2009.

firstly, i never liked the guy. he is age-barred, half bald , a shorty and ugliest creature on earth to my knowlege.
my father along with his 5 sisters and three brothers convinced (rather tortured and humiliated) me until i agreed to marry this guy(since he has vast amount of money and property. they are landlords in their small village).this so called husband of mine works in a call center(24x7 customer) at bamglore and has been there since marriage.

even after a year and a half my story hasnt changed. in the month of december my dad(who resides in saudi) came to india and made me sign on a mutual divorce petition(not on stamp paper). this petition was written by my husbands uncle. howevr, since my dad agreed to take care of me, i was made to sign on it. later on(a month later. my father had left to saudi by then), when my father changed colors, i withdrew and protested that i will continue to live with my husband. this was when i learnt that my father is getting his 5lakhs which he had given as dowry to the groom.

now i say that i should recive the permanant alimony. to this neiher my father nor my inlaws agree. and iam still in my parents house. the truth is that my father has remarried recently and left for saudi eversince. he is a careless and negligent father. how long do i wait?

if i file in court i need huge money. moreover it will take years to resolve. iam really desperate to end this nonsense.

please enlighten me with the rules and regulation of muslim marriage act. how much permanant alimony can i demand? what about the maintenanace for this one and a half year stay at parents house?what if my husband remarries? i shall never argree to reconcile then.

my father is the major cause for trouble in all our lives.

I do not see any valid or lawful reason in your post for seeking divorce.Alimony depends on your status,requirements etc.

the reason i demand for permanat alimony is that my father is not willing to take care of me anymore. he has a very careless attitude towards family goals and responsibilities as it is evident from his behavior. hence , to reconstruct my life i need to have financial suport. iam planning to continue my further studies and hopefully remarry. so, i need money. Moreover , who is to be blamed for spoiling my life? who should be penalised? certainly this is not a love marriage.

i have been staying away from my husband and inlaws for the past 1.5 years with no maintenance either from my dad or husband.

Moreover permanant alimony is every divorcee's right. isnt it?

You can file petition before Human right commission or to women commission and it is less expensive.

you can approach an Advocate in your area deal with family matter, there are seven grounds which are available to muslim women in THE MUSLIM WOMEN (PROTECTION OF RIGHTS ON DIVORCE) ACT, 1986.for your perusal i am attaching the file.

sir/madam,
i had filed a petition in women police station in the month of april on 21st. however the SI did not book an FIR for two months . my husband submitted anticipatory bail in the station and the SI gaveup. at the end the SI asks me if an FIR is required. however and FIR is yet not made.

iam really confused and worried. i have no support from my father. i have been running from pillar to post asking my elders to resolve this . but they turn a deaf ear.


what if i directly go and catch hold of my husband? can he take any action by law like file a harassment case following his anticipatory bail?can i seek police protection?


or how about if i approach the district QAZI? will he resolve the issue completly? can my husband excercise anticipatory bail at QAZI?

please help.
