Society had collected Rs.79500/- fromeach member for Deemed Conveyance & Property Card. Total collection 79500 X 56 Members = Rs.44,52,000/-. Society has balance of Rs,2000000/- which they want to refund to the Members. One original member sold her flat and now new member occupies that flat. Who will get that refund - Old member who sold the flat or new member who purchased the flat.
A society collected funds from members for Deemed Conveyance & Property Card. Now, they have a surplus and wish to refund it. A question has arisen regarding a member who sold their flat: should the refund go to the original member who paid, or the new owner? The general consensus is that the original member who paid the amount is entitled to the refund, but it's advised to check the society's bylaws for any specific clauses.

The original member paid the amount, so it will go to the original members. However verify the rules of the bylaws of the society if there is any clause for it and proceed.

What is your locus standi to subject amount / flat ? The society is stated to have collected a sum of Rs. 79,500 x 56 which comes to 44, 52,000/- then how come it is calculated to Rs. 20,00,000/- for refund to its members? What do you mean by the term "deemed conveyance" used by you? What was the purpose of collection of the amount for deemed conveyance and property card since society has no authority / concern with conveyance of the property ? Whether the vendor has calculated the amount in the consideration amount of the property at the time of sale to vendee ?

The refund amount belongs to the person who paid it, hence the original person shall be entitled for refund amount
