Undeserved termination from mnc

Dear Experts,

Kindly assist me in the matter of Termination

I have been serving an American MNC gurgaon since last five years, and I am eligible for gratuity also. During the five years of working I am getting continuously appreciation's and Job well-done for excellency in work. Company has the two types of staff (Permanent & Contractual) with 60% (Permanent) + 40% (Contr.) I am in permanent staff. Now company has lost two projects which results reduction in employees but In which project I am working is running smoothly and since two years and the work is in the project for more two years and in the same project I got many appreciation. Now company asking me for resignation and avoiding my excellency in work and this is because of some buttery people of manager.

Company is being fired only few permanent candidates whether mostly contractual are being fired. Please let me know how I can protect myself against this cheat and what the legal rights I have to protest/action against the company.

I have all the appreciation proofs in e-mail.

Record (audio/visual/witnessed/minuted) proof of demand of resignation.


Submit a gentle representation addressed to good offices of appointing authority,MD etc and save yourself and let the buttering person go out,if you can handle it.


Or tender notice of resignation and be with some reputed organization that is financially sound and has good HR practices.

Thanks Mr Kumar for you kind help! There is a blind rule in the company that if I have any problem or concern then I can talk to my reporting supervisor only and very least case that I can go up to manager but all are under buttering person's feast. If I go to higher officer then he does not listen to me blindly and HR department also deaf in my company thats why I wanted to ask for legal action or rights. And yes there is possibility to record audio/video. kindly suggest.

Verbal transactions are not on record and are difficult to prove.


You are being asked to give up your employment although you are extra ordinary performer.


In case you land up in problem then evidence alone shall be of some help.


If line managers and HR personnel are biased then good offices are to be approached in person/writing under proper acknowledgment, and some record should be built.



Or you can approach an able counsel specializing in labor-service matters and proceed further under expert guidance of your counsel.

But in the such case Government can not help me, is there no any rule/act to protect employee's rights in private companies???

what is the means of good offices, please describe..

Good Offices; Look into 1st post. It is MD,appointing authority etc.......


Record the evidence of demand of resignation.Look into 1st post, carefully.


Firm up your next employment and if you have been a performer you can be with a good employer at better position with better remuneration.



Discuss your issues and posts in this thread with elders of the family, experienced well wishers, and alongwith them you may approach an able counsel specializing in labor-service matters and proceed further under expert guidance of your counsel.


You can also approach Inspector appointed under Shops & Estbs Act, O/o Labor commissioner, employees/trade union leaders.
