hai everybody,
please clarify whether the daughter can claim partition in the estate of her coparcenary father who died in the year 1966
but continued the coparcenary of the co-ownership till the date of filing of suit?

The matter is very much arguable.A succession opens soon a person dies and can not remain devolution less awaiting amendments to come forward in future to prove rights to those who do not have on date of death, forces me to answer in negative although a supreme court judgements given post amendments supports your claim with which i disagree with due respect.

The ground of a joint dwelling is no more a good defence to a suit of partition by a lady coparcener as the very section creating disability in this regard has been repealed.

She can definitely claim partition but her right shall not be equal to her brothers.
